https://jobs.spa-uk.org/ (the “Site”) is owned, operated and managed by The UK Spa Association (“we”, “us”, “our”) and administered by 4Leisure Recruitment Ltd (4LR).

We recommend that you print a copy of these Terms & Conditions for future reference.

These Terms & Conditions apply together with our Privacy Policy, which governs how we process personal data.


1. Introduction

These Terms & Conditions apply to all users of the Site, including job seekers, recruiters, employers, and visitors (“you”, “your”).

By accessing or using the Site, or by creating an account, you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Site.


2. Purpose of the Site

The Site is provided solely for lawful recruitment and employment-related purposes within the spa, wellness, beauty, and related sectors.

We reserve the right to suspend, restrict, or terminate access to the Site or your account at any time, without notice, where we reasonably believe you have breached these Terms or applicable law.


3. Content on the Site

The Site may include:

  • Job advertisements
  • CV databases
  • Career information
  • Employer profiles
  • Links to third-party websites

Some content is provided by third parties, including employers and job seekers (“Third-Party Content”). We do not verify, endorse, or guarantee the accuracy, completeness, legality, or availability of Third-Party Content.

You acknowledge that:

  • Job availability is not guaranteed
  • Statistical or informational content may represent a snapshot in time
  • Career advice content is informational only and not professional advice
  • You also authorise us to re-format your third party content for the sole purpose of making it accessible on different devices.

 


4. User Responsibilities

You agree that you will not:

  • Use the Site for unlawful or fraudulent purposes
  • Upload misleading, discriminatory, defamatory, obscene, or offensive material
  • Upload confidential or sensitive personal data (e.g. passport numbers, bank details)
  • Impersonate another person or organisation
  • Attempt to compromise Site security or functionality

We reserve the right to remove content and suspend or terminate accounts that breach these obligations.


5. Account Registration & Security

Where account registration is required:

  • You must provide accurate and up-to-date information
  • You are responsible for maintaining the confidentiality of your login credentials
  • We are not responsible for unauthorised access resulting from your failure to protect your credentials
  • You must not submit and/or upload anything that could result in adverse consequences, including but not limited to fraud or identity theft.

You must notify us promptly if you suspect unauthorised use of your account.


6. Job Seekers

If you create an account as a job seeker:

  • You have the option to authorise us to make your profile and application materials available to recruiters and employers
  • You acknowledge we do not vet employers or guarantee the legitimacy of job listings
  • You are responsible for verifying opportunities before taking employment-related decisions

Applications sent via the Site are transmitted using information provided by employers, and delivery or response is not guaranteed.


7. Recruiters & Employers

If you create an account to advertise vacancies:

  • You are responsible for the accuracy and legality of your job listings
  • You must comply with employment, equality, immigration, and data protection laws
  • You acknowledge we do not screen candidates or guarantee suitability
  • You undertake to ensure that any Third Party Content uploaded to the Site by you is true, accurate, not misleading and free from defamatory, discriminatory, obscene, offensive or otherwise illegal or unlawful content. You are responsible for ensuring that all information you provide is free of viruses or other harmful content that may damage or interfere with the Site's system, servers, networks or data prior to your submission to the Site.

 

You agree to indemnify us against claims arising from your content, recruitment practices, or misuse of candidate data.


8. Intellectual Property & Licence

You retain ownership of content you upload.

By uploading content, you grant us a non-exclusive, royalty-free licence to use, display, format, and distribute that content for the operation and promotion of the Site.

You warrant that your content does not infringe third-party rights and agree to indemnify us against related claims.


9. Use of Information

We may use information submitted through the Site to:

  • Operate and improve the Site
  • Analyse usage patterns
  • Facilitate recruitment activity
  • Any information shared with us or 4LR will be used solely for the purpose of operating this site

All personal data is processed in accordance with our Privacy Policy.


10. Our relationship with 4LR

We engage 4LR to administer this site. They are responsible for the day to day operation of the site.

They will:

  • Register clients’ accounts and provide guidance on using it
  • Provide advice on how to get the best out of the site
  • Provide technical support
  • Offer you additional services if you are not getting the results you need

They will not:

  • Retain client data other than for the operation of this site
  • Use candidate data for any purposes other than the operation of this site

11. Third-Party Websites

The Site may contain links to third-party websites. We are not responsible for their content, policies, or availability. Use of third-party sites is at your own risk.


12. Availability & Interruptions

We do not guarantee uninterrupted access to the Site. We may modify, suspend, or withdraw the Site at any time without liability.


13. Termination

We may suspend or terminate access immediately where:

  • These Terms are breached
  • Unlawful activity is suspected
  • Continued access may expose us or users to risk

You may close your account at any time via account settings or by contacting us.


14. Liability

Nothing in these Terms limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation

To the fullest extent permitted by law, we exclude liability for:

  • Loss of profits, revenue, business, or opportunity
  • Data loss or corruption
  • Indirect or consequential loss

Use of the Site is at your own risk.


15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site constitutes acceptance of the current version.


16. Governing Law & Jurisdiction

These Terms are governed by English law, and the courts of England and Wales have exclusive jurisdiction.


17. Advertisement Terms & Conditions (Recruiters)

Where paid advertising or recruitment services are provided:

  • A contract is formed upon acceptance of a booking or order
  • Payments are made directly to The UK Spa Association
  • Charges, duration, and services are defined at point of purchase
  • Payments must be made in accordance with agreed terms

We reserve the right to suspend services for non-payment or breach.


18. Modern Slavery Statement

The UK Spa Association is committed to preventing modern slavery and human trafficking in its operations and supply chains.

We:

  • Conduct appropriate due diligence
  • Require ethical conduct from partners and suppliers
  • Encourage reporting of concerns
  • Operate a zero-tolerance approach to exploitation

This policy is reviewed annually.

 

Advertising Terms & Conditions

1. Interpretation

1.1 Definitions

In these Advertising Terms & Conditions, the following definitions apply:

Affiliate
Any entity that directly or indirectly controls, is controlled by, or is under common control with a party.

Applicable Law
All applicable laws, statutes, regulations, codes of practice and guidance in force from time to time.

Administrator

A third party charged with the operation of the site.

Booking Form
The online or written form confirming the Customer’s details, selected advertising services, duration, and applicable charges.

Business Day
A day other than a Saturday, Sunday or public holiday in England when banks in London are open for business.

Charges
The fees payable by the Customer for the Services.

Contract
The binding agreement between The UK Spa Association and the Customer.

Control
Has the meaning given in section 1124 of the Corporation Tax Act 2010.

Customer
The individual, partnership, or organisation purchasing advertising or recruitment services through the Job Board.

Customer Materials
All text, images, logos, job descriptions, branding, and other content supplied by the Customer for use in advertisements or listings.

Intellectual Property Rights
All copyright, trademarks, database rights, design rights, and other intellectual property rights, whether registered or unregistered.

Mandatory Policies
Policies published on the Job Board website, including the Website Terms & Conditions and Privacy Policy.

Services
The recruitment advertising and related services provided through the UK Spa Association Job Board.

Supplier
The UK Spa Association, or any trading entity operating the Job Board on its behalf.

Term
The duration for which the Services are provided..

VAT
Value Added Tax in accordance with UK legislation.

Appointed Administrator for the site.


2. Commencement and Duration

2.1 The Contract commences when the Supplier or Administrator receives submission of an advert and continues for the Term stated, unless terminated earlier in accordance with these terms.

2.2 Any person submitting an advert on behalf of a Customer confirms they are authorised to do so, and the Customer will be bound accordingly.


3. Supplier Responsibilities

3.1 The Supplier or Administrator will use reasonable endeavours to provide the Services in accordance with these terms.

3.2 The Supplier may appoint an Administrator to manage the Services but reserves the right to change that contact where necessary.


4. Customer Obligations

The Customer agrees to:

  • Provide accurate, lawful, and complete Customer Materials
  • Ensure job advertisements comply with employment, equality, and data protection law
  • Cooperate with the Administrator in delivering the Services
  • Hold all necessary rights, licences, and permissions for submitted materials
  • Comply at all times with the Mandatory Policies
  • Pay all Charges when due

The Supplier or Administrator may suspend or restrict Services where Customer obligations are not met.


5. Charges and Payment

5.1 Charges are as set out in advance and are payable in full.

5.2 Invoices are payable before any advert goes live unless otherwise agreed.

5.3 Late payments may incur:

  • Interest at 8% above the Bank of England base rate
  • Recovery costs
  • Suspension or termination of Services

5.4 Charges are inclusive of VAT unless stated otherwise.

5.5 The Supplier or Administrator may suspend all Services where any invoice remains unpaid.


6. Intellectual Property

6.1 Each party retains ownership of its own Intellectual Property Rights.

6.2 The Customer grants the Supplier and Administrator a non-exclusive, royalty-free licence to use, reproduce, adapt, and display Customer Materials solely for the provision and promotion of the Services.

6.3 The Customer warrants that Customer Materials do not infringe third-party rights and agrees to indemnify the Supplier and Administrator against related claims.


7. Legal and Policy Compliance

All parties shall comply with:

  • Applicable Laws
  • Mandatory Policies
  • Advertising, employment, and equality legislation

8. Limitation of Liability

8.1 Nothing limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Liability that cannot legally be excluded

8.2 The Supplier nor Administrator is not liable for:

  • Loss of profits, revenue, or business
  • Loss of data or goodwill
  • Indirect or consequential loss

8.3 Total liability is limited to the lesser of:

  • Charges paid under the Contract, or
  • 10% of the Customer’s average annual Charges

9. Cancellation

9.1 Customers may cancel before an advert goes live.

9.2 After adverts go live, cancellations are not permitted and Charges remain payable.


10. Termination

Either party may terminate immediately if the other:

  • Commits a material breach not remedied within 14 days
  • Becomes insolvent or ceases trading
  • Repeatedly breaches these terms

The Supplier or Administrator may terminate for non-payment or misuse of Services.


11. Consequences of Termination

Upon termination:

  • Outstanding invoices become immediately payable
  • Use of Customer Materials ceases upon request
  • Clauses relating to liability, IP, and interpretation survive

12. Force Majeure

Neither party is liable for failure caused by events beyond reasonable control, including natural disasters, government actions, or system failures.

If such events continue beyond three months, either party may terminate with notice.


13. Entire Agreement

This Contract represents the entire agreement between the parties and supersedes all prior discussions or arrangements.


14. Third Party Rights

No third party has rights to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.


15. Notices

Notices must be in writing and may be sent by:

  • Email
  • Post
  • Hand delivery

Notices are deemed received in accordance with standard UK business practice.


16. Governing Law

These Terms & Conditions are governed by English law, and the courts of England and Wales have exclusive jurisdiction.
